CardYard connects buyers and sellers but is not the seller of user-listed products. Statutory rights always remain applicable.

1. Definitions

CardYard is the online trading-card marketplace operated under the name CardYard by CardYard B.V. The Platform includes the website, user accounts, listings, messages, offers, facilitated payments and additional services.

A User accesses the Platform or holds an account. A Buyer purchases products; a Seller lists products. A Business Seller acts in the course of business; a Private Seller does not act in the course of business for the transaction concerned. Premium means the separately offered subscription for additional platform features.

2. CardYard's role

CardYard is an independent marketplace and, unless expressly stated otherwise, is neither the buyer nor the seller of products listed by users. Each sales agreement is between the Buyer and Seller directly. CardYard may earn a platform commission for facilitating transactions.

CardYard offers no general buyer guarantee, self-operated escrow or independent authenticity warranty. CardYard remains responsible for its own services and non-excludable legal obligations. The Platform identifies the Seller and their trader or private status before purchase.

3. Acceptance of terms

These terms govern the agreement between CardYard and each User. During registration the User must expressly accept the available version of the terms; CardYard records the version and acceptance time.

The Privacy Policy is separate from these terms. Marketing and non-essential-cookie consent are requested separately where required. Additional terms, shown in advance, may apply to selling and Premium features. Mandatory law prevails over conflicting provisions.

4. Accounts and age

Users aged 16 or older may register where permitted by local law. Users aged 16 or 17 may only enter into transactions for which they are legally authorised or have the required consent of a parent or guardian.

Minors may sell only if applicable law and Stripe's age and verification requirements are met, including parental or guardian involvement where required. CardYard may restrict sales until verification is complete. Users must provide accurate details and safeguard credentials. Identity misuse and circumventing account restrictions are prohibited.

5. Seller responsibilities

Sellers may offer only products they lawfully have authority to sell. Listings must be accurate, complete and not misleading, disclosing actual condition, origin, authenticity, damage, grading and other material details.

The Seller is responsible for performance of the sale, shipment, delivery, applicable warranties, taxes, customs requirements, and lawful return and refund rights. Business Sellers must accurately disclose their status and comply with applicable consumer rights. Sellers must cooperate with legally required identity and tax checks, including applicable DAC7 and trader-traceability obligations.

6. Permitted products

Only officially produced, lawfully tradable trading cards and directly related products are permitted, including single cards, officially graded cards, authorised reprints, promotional cards, booster packs, boxes and sealed products.

Counterfeits, unauthorised replicas, stolen items, false certificates or grading labels, and deceptively resealed products are prohibited. Products described as sealed must genuinely match that description. Users may upload only images they have rights to use and must follow any mandatory scanning or photo requirements.

7. Listings, offers and contracts

The Seller sets the asking price and the permitted sale method. Pricing and fees must comply with applicable pre-contract information duties. Offer rules and expiration are those disclosed in the relevant offer interface.

The time at which a binding sales agreement arises is determined by applicable law and the disclosed ordering process. A cart may contain products from several Sellers, but payment is completed separately for each Seller. A reservation is not itself a confirmed payment.

8. Payments and commissions

Buyers pay through Stripe directly to the Seller's connected Stripe account. CardYard receives only the platform commission disclosed in advance from that payment. Sale proceeds remain in the Seller's Stripe balance, not in CardYard's balance or bank account.

The Seller manages payouts and handles lawful refunds and payment disputes through Stripe. CardYard does not hold sale proceeds pending confirmation of receipt, approve payouts based on an assessment of the card, or provide escrow or general buyer protection. Stripe may apply its own checks, reserves, payout delays and reversals. Responsibility for payment and dispute fees and negative balances follows the applicable Stripe account settings and agreements; these terms do not change that allocation.

Commission is payable for the agreed Platform service once a sale is formed and payment succeeds. Commission is generally not refunded following a subsequent cancellation, return, refund or dispute between Buyer and Seller. When the Buyer is refunded, any retained commission remains the Seller's cost and must not be deducted from a refund to which the Buyer is legally entitled.

Incorrect or excessive commission is corrected. Full or partial refunds required by law remain available, including valid withdrawal from the Platform service or termination for CardYard's failure to perform. A Private Seller may be a consumer in their relationship with CardYard. A statutory withdrawal right for a service ends only after full performance and satisfaction of all applicable information and consent requirements. These terms alone are neither a request for immediate performance nor a waiver of withdrawal rights.

Commission and other applicable costs are disclosed clearly in advance. For existing Users, a changed commission rule applies only to future transactions after required notice and any applicable notice period have been observed; earlier transactions are not changed retroactively.

9. Circumvention of fees

Users must not divert a transaction formed through CardYard to an outside payment method for the purpose of avoiding CardYard's fees. CardYard may impose lawful, proportionate measures and seek genuinely owed commissions or proven losses resulting from violations.

This rule does not prevent users from independently listing, buying or selling elsewhere or exercising rights protected by mandatory law.

10. Shipping and risk

Sellers must dispatch orders within three business days after payment confirmation, unless a permitted alternative period was agreed in advance. Every shipment requires tracking and the Seller must provide the tracking code on the Platform. The Seller is responsible for safe packaging, proper addressing and fulfilling delivery duties.

Shipping insurance is optional. Lack of insurance does not transfer statutory shipping risk to CardYard or the Buyer. Mandatory delivery and risk-transfer rules continue to apply to business-to-consumer sales. Tracking alone does not conclusively prove what was delivered.

11. International trade and customs

The website is accessible worldwide, but buying, selling and payment features are offered only in jurisdictions CardYard can lawfully and technically support. Sellers choose among supported shipping destinations.

Buyers and Sellers must comply with applicable import, export, sanctions and customs laws. Mandatory pricing information, shipping fees and known additional charges must be disclosed in advance. Import charges fall on the party to whom they can lawfully be allocated under the contract and applicable law.

12. Returns and statutory rights

Consumers buying from Business Sellers retain applicable statutory withdrawal, delivery, conformity, warranty and remedy rights. Transactions between private individuals do not automatically carry the same statutory withdrawal right. Users may agree on additional return terms.

The Seller is responsible for lawful return, withdrawal and refund requests. Opening a sealed collectible does not automatically eliminate a statutory withdrawal right. CardYard does not routinely refund purchases from its own funds and offers no general buyer guarantee; its own mandatory obligations remain.

13. Disputes between users

Disputes over products, authenticity, condition, payment, shipment or delivery are normally resolved directly between Buyer and Seller. CardYard is not the default arbitrator and does not offer general purchase protection.

CardYard may review reports, request information and moderate accounts or listings. Doing so does not mean CardYard assumes the Seller's obligations. Chargebacks and payment disputes are subject to Stripe, the relevant payment scheme and applicable law.

14. Fraud and enforcement

Fraud, threats, spam, impersonation, deception, counterfeits and unlawful listings are prohibited. CardYard may warn users about minor breaches. Serious fraud or safety risks may justify immediate listing removal, restrictions or suspension.

CardYard provides reasons and appeal or complaint routes where required by law. The Digital Services Act and Platform-to-Business rules apply where relevant. Evidence of suspected fraud is retained only where necessary and lawful, CardYard cooperates with lawful requests from police and judicial authorities concerning suspected fraud. Available records, such as listings, card images, AI assessment results and order details, may be provided to support a police report or investigation only on a valid legal basis. CardYard shares only necessary information and cannot guarantee that every transaction can be fully reconstructed. AI assessments are not proof of guaranteed authenticity.

15. AI scanner, grading and encyclopedia

AI identification, automated assessments, historical prices, charts and value estimates are informational only. They are not official authenticity certificates, professional grading, certified appraisals, or warranties of market value or future prices.

Automated outputs can be incorrect or outdated. Users must verify material product information themselves. CardYard does not present AI findings as official verification by PSA, BGS, CGC or another grading body. Liability for its own misleading statements or deficient services is not excluded where mandatory law forbids it.

16. Premium subscriptions

Premium provides the features described at purchase, potentially including lower selling fees, statistics, badges and other tools. The current price, monthly billing term, automatic renewal and cancellation instructions are displayed clearly before payment.

A paid subscription starts only following a separate purchase. It can be cancelled through subscription settings; timely cancellation prevents later renewals, and paid access normally continues until the end of the billing period. A Premium badge is not an authenticity or trust certification.

Nothing in these terms removes consumers' statutory withdrawal rights, remedies for defective digital services or other mandatory protections.

17. Premium: no discretionary refunds

Once a paid Premium billing period has started, CardYard does not voluntarily issue full or partial refunds merely because the User used the service rarely, changed their mind, cancelled late or no longer wants to sell. Cancelling stops future renewals; it does not automatically refund previously paid periods.

This policy applies only to the extent permitted by law. Consumers retain any applicable statutory withdrawal period, generally 14 days from entering the agreement. If a consumer expressly requests immediate performance during that period and all statutory information and consent requirements have been satisfied, CardYard may charge a legally permitted proportionate amount for service already provided.

Refunds required by law, including for non-performance, non-conformity, unauthorised charges, unlawful renewals or other mandatory reasons, remain available. Users may dispute card charges with their issuer; CardYard may contest unfounded chargebacks with lawful evidence. This policy cannot prevent a chargeback claim or override the card issuer's decision.

18. First 100 users: free Premium

The first 100 qualifying Users under the published promotion conditions receive one calendar month of Premium at no charge, generally limited to one promotion per person. Artificial or duplicate accounts created to abuse the promotion may be excluded.

The free month never converts automatically into a paid subscription. A payment obligation arises only after a new, separate and explicit paid sign-up showing the relevant price and renewal terms. Properly awarded promotional benefits are not arbitrarily withdrawn retroactively.

19. Admin-granted Premium

CardYard may grant free Premium access to testers, partners or other users. Such access does not create a payment obligation and may be ended only under the applicable grant terms and law.

A CardYard-granted Premium badge does not certify the User as a trusted Seller or guarantee any products.

20. Sponsored listings and ranking

CardYard may offer paid featured listings and Premium visibility. Commercially promoted results are clearly identified.

The main parameters determining listing ranking and the potential effect of paid promotion are explained on the Platform. Premium status must not be represented as an official authenticity certification. Fake reviews, artificial views and ranking manipulation are prohibited.

21. Intellectual property

CardYard retains rights in its software, design, names and original content. Users retain rights in their own images and text and license CardYard non-exclusively to display, process and reasonably promote that content for Platform purposes.

Users warrant that they have the necessary permissions. References to Pokémon, Yu-Gi-Oh!, PSA, BGS or CGC do not imply CardYard affiliation. Infringing material may be removed and proportionate measures imposed.

22. Privacy and communications

CardYard processes personal data under applicable privacy law, including the GDPR, for legitimate account, payment, security, communications and statutory purposes. Processing grounds, recipients, international transfers, retention periods and rights are described in the separate Privacy Policy.

CardYard may send necessary transaction and account emails. Marketing is sent only with a valid legal basis and applicable opt-out controls. Non-essential cookies require consent where legally required. Fraud-related information is retained no longer than lawfully necessary.

23. Availability and security

CardYard aims to provide secure and reliable services but cannot guarantee uninterrupted availability of every feature. Maintenance, outages and third-party problems may temporarily affect access.

Users must not bypass security, attack or disrupt systems, unlawfully harvest data or harass others. CardYard remains responsible for its own mandatory security and service obligations.

24. Liability

Operating a marketplace alone does not make CardYard liable for independent Sellers' failures, including counterfeits, undelivered shipments or inaccurate listings.

CardYard's responsibility for its own acts is governed by applicable law. Liability to business users for indirect or consequential loss may be excluded where lawful and reasonable. No arbitrary or undetermined monetary liability cap is imposed. Nothing excludes liability that mandatory law prohibits excluding, including relevant wilful misconduct or deliberate recklessness by management. Consumers retain their mandatory rights.

25. Recovery of losses and indemnities

A Seller who causes CardYard proven and reasonable loss through fraud, unlawful conduct or an attributable contractual breach may be required to compensate that loss where legally allowed.

Recoverable chargeback costs may be included. Business Sellers may indemnify CardYard, within legal limits, against third-party claims directly attributable to those Sellers. CardYard cannot automatically pass on its own faults. Private users remain protected against unfair contract terms. Amounts are not charged without a valid legal basis.

26. Changes, suspension and termination

CardYard may change terms for justified reasons such as legal, security, cost or service changes, with clear and timely notice. Where the Platform-to-Business Regulation applies, changes generally require at least fifteen days' notice, or longer where required. Complete termination of business accounts generally requires thirty days' notice where applicable, subject to statutory exceptions.

Users may close accounts, without cancelling existing sales agreements or lawful payment obligations. Restrictions must be proportionate, and legally required reasons and appeals are provided. Previous versions remain identifiable.

27. Complaints, law and final provisions

Complaints about CardYard's own services and reports of suspected illegal content may be sent to tradecardeu@gmail.com or through the published reporting channel. Complaints about a sales agreement are normally addressed to the Seller, without prejudice to statutory procedures.

Dutch law governs the platform agreement, without depriving consumers of mandatory protections applicable under conflict-of-law rules. Disputes are brought before the legally competent court. If any term is unenforceable, the remaining terms continue to apply to the extent legally permissible.
